No updates have been made to Cannabis/ hemp- CBD laws in Ohio.

In addition to the federal hemp laws laid out in the 2018 Farm Bill, each state has its own state hemp laws. Before we dive in on Ohio Hemp Laws and the legality of CBD in Ohio, it is important to understand the different types of hemp and CBD products that these laws may be applied to.

Is Full Spectrum CBD Legal in Ohio?

That is a trick question because full-spectrum CBD is not the same as the so-called PCR Hemp Oil! This new marketing term is certainly introducing even more confusion around CBD products.

Ohio does not appear to have any specific restrictions on CBD products. So long as they meet requirements for testing and labeling they can be manufactured and sold in Ohio legally under Ohio hemp laws.

How Does Ohio Legally Define Hemp?

“Hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than three-tenths per cent on a dry weight basis.

Growing and Selling Hemp in Ohio

Ohio hemp laws are explained in Senate Bill 57, along with ORC 928 and OAC 901. Hemp farming, processing, and CBD product sales and manufacturing are all legal in Ohio. Ohio Hemp laws are very detailed. They classify different types of hemp crops depending on their use and also have some hemp varieties which are prohibited (sharing a list with Michigan).

Retail Hemp and CBD products must comply with Ohio hemp laws:

“Delta-9 tetrahydrocannabinol” means the sum of the percentage by weight of tetrahydrocannabinolic acid multiplied by 0.877 plus the percentage by weight of delta-9 tetrahydrocannabinol.
